What is Litigation Management?  asks the inaugural issue of Litigation Management, a publication of the Council on Litigation Management.

The answer can be found in the goals of litigation management (LM), which not coincidentally correspond with the goals of science: to observe, to predict and control.  Among practitioners of litigation management there is great excitement at the prospect of grasping the levers of scientific prediction and control to put the brakes on litigation costs and accelerate efficiencies.

But, as a direct descendant of scientific management, LM will require scientific methods if it is to achieve its goals. Litgation managers must first master the scientific methods of measurement and prediction from which controls may be scientifically calibrated and engineered.

Yet, some litigation managers are still undecided about whether LM is an art or a science.  In reality it is both, as the art of LM resides in learned and skilled application of the science.  The benefits of science -- prediction and control -- only come through the disciplined adherence to its methods.
